Outrage in Arkansas and Important interview

A Springdale man accused of raping an underage girl claims his confession to police should not be allowed at trial because he speaks limited English and had no translator. Jesus Dominguez, 33, of Springdale has been charged with two counts of rape. He is accused of molesting a now-16-year-old girl several times beginning when she was 5. Prosecutors are expected to amend the charges to include additional counts of rape before the case goes to trial. Dominguez, also known as Jesus Dominguez-Vasquez, faces separate charges of failure to pay child support. Both cases were set for trial on May 1 but will be rescheduled. A hearing on the motion to suppress the statement to police will be scheduled and completed before a new trial date is set, according to court officials.
“ Although (Dominguez ) was born and educated in Mexico and has only limited ability to communicate in English, an interpreter was not provided at any time... including that portion of the interview when (he ) was advised of his Miranda rights, ” the motion states. Dominguez answered the detective’s question with the single word “ yeah” 24 times in the 19-page transcript of the interview with Fayetteville police, the motion states. His response was completely or partially inaudible 19 times. These brief or inaudible responses indicate his limited capability to substantially understand the questioning conducted entirely in English, the motion states.

Police: Confession OK Fayetteville police provide interpreters when suspects ask for one or if it appears to officers that a suspect needs one, said Lt. Jamie Fields of the Police Department’s Criminal Investigation Division. Dominguez did not ask for an interpreter or appear to need one, she said. “ We are confident with this case as far as his statement goes, ” she said. “ We had every indication he spoke English. ” Fourth Judicial District Deputy Prosecuting Attorney Terra Stephenson said before conducting the interview police had learned from the suspect’s family and co-workers that he spoke English. The Miranda warning was explained to Dominguez, and he signed it, she said. “ Police and prosecutors take Miranda warnings very seriously, ” she said. Stephen Taylor, Dominguez’s attorney, would not discuss the specifics of the motion or the case, but he said the need for translators during police interrogations is a “ big change around here. ” “ We are going to have to deal with it more and more, ” Taylor said. Dominguez is currently being held in the Washington County Detention Center on a $ 100, 000 bond for the rape charges and a $ 2, 500 bond on the charge of failing to pay child support. Nabbed at border Police had been searching for Dominguez since 2004 when he was captured in late October at a border checkpoint as he was traveling from Mexico into Texas. was on an - ing warrant for a charge of failing to pay child support and was extradited to Arkansas. Physical evidence Police reports show that the rape case against Dominguez is not limited to the confession, that physical evidence backs up the allegations. The accuser first reported the incident to police three years ago, according to a preliminary arrest report. She told officers that Dominguez had raped and sexually assaulted her for several years. She also said that Dominguez threatened her against telling her mother and occasionally bribed her with money. An exam performed by a sexual assault nurse examiner revealed damage and past trauma to the victim’s genitalia. Dominguez said he may have given the accuser money to prevent her from telling anyone about the encounters, according to the report. A mental heath evaluation of Dominguez has been ordered in the case, according to court records.

The story fails to mention the immigration status of Dominguez or the mother. We also don't know if Dominguez getting legal help from the ACLU, the Mexican Consulate or some other pro-illegal group. The media appears to be downplaying the illegal immigration issue of this story.

House hopefuls split on illegal-alien laws

FORT SMITH - Sebastian County legislative candidates disagreed at a forum Monday over whether Arkansas should crack down on employers in an attempt to curb illegal immigration.
The county shares a border with Oklahoma, where one of the strictest state immigration laws took effect in November. Under the law, employers may be guilty of a felony if they know, or act in reckless disregard of the fact that, an employee is in the United States illegally. Brandon Woodrome, a Fort Smith Republican running for the state House seat in District 64, said that his immigration plan includes measures similar to Oklahoma’s new law. He said illegal immigration rewards business at the cost of the middle class. “It’s costing taxpayers thousands of dollars so that big business can have cheap labor,” Woodrome said. “We’ve got to take a stand and quit allowing this.” A study released by the National Conference of State Legislatures reported last week that as of the end of March, state lawmakers nationwide had considered at least 1,606 immigrationrelated bills this year. Twenty-six states had enacted 44 laws on the subject. The Arkansas Legislature doesn’t meet in regular session again until January, when the 87th General Assembly convenes. Lawmakers have been discussing for months what type of legislation to introduce next year and whether a law like Oklahoma’s is in order. Woodrome’s opponent in the May 20 primary, Stephanie Malone of Fort Smith, said she needs to read the Oklahoma law in more detail. But she said she agrees with the idea that state government should target businesses that knowingly hire illegal aliens. She said she’s not sure she’d sponsor legislation as sweeping as Oklahoma’s, however. “I’ve heard there have been some backlashes,” Malone said.


Democratic opponents in the District 65 race said they would not support legislation that goes after employers in part because verifying workers’ eligibility is so difficult. Mark Horoda, a Fort Smith lawyer who’s challenging Rep. Tracy Pennartz of Fort Smith in the May 20 primary, said it’s laudable for the state to try to take on enforcement when the federal government doesn’t.
But he said it’s too easy to fake documents. “We’re in a computer age where it’s very possible to make a sophisticated forgery with very little effort,” he said. “I am not trained as an expert document examiner, and I dare say I don’t know anybody in the regular work force that’s trained to do that, either.” A better way might be requiring employees to take payment through a bank account, which could require a more sophisticated verification system, he said. “My question is, can we think outside the box, instead of just always trying to point at the employer who’s not necessarily that qualified to address the issue?” Horoda asked. Pennartz said she agreed with Horoda about the difficulty of verifying employee documents. Primary responsibility for enforcement of immigration policy lies with the federal government, which must take on more of the burden, she said. “The states have been very innovative in some of the ways we’re trying to meet the challenge of illegals in our country,” Pennartz said. “We can’t shoulder that responsibility alone.” In discussing immigration, Woodrome didn’t go as far as he did in a recent interview with the Arkansas Democrat-Gazette. In the interview, he said he’d be in favor of asking Hispanics for citizenship documents. “If you run across a Hispanic, then just ask them, are you an illegal immigrant? Can I see your papers? Can I see your license? That’s not - I’m sure if I was in a presidential race, I’d be touted as a racist, fascist whatever,” he said. He later said that if that’s a problem, perhaps all people pulled over at traffic stops or making contact with law enforcement should be asked for documents. He said he’s not sure yet what type of document would be sufficient to prove citizenship. Malone, in an interview, said she doesn’t agree with Woodrome. “That’s kind of radical,” she said. In clarifying his statements last week, Woodrome said he doesn’t want to target only Hispanics but wants to find “a solution fair and equal to all.”
The winner of the race in District 64 between Malone and Woodrome will face Mike Bock, a Democrat. The seat is open because Rep. Jim Medley, R-Fort Smith, is barred by the state’s term-limits amendment fromseeking re-election. There is no Republican candidate in District 65. Monday’s forum was sponsored by the Fort Smith chapter of the League of Women Voters.

18 Illegal Immigrants Arrested In Raid To Be Deported

LITTLE ROCK -- Eighteen illegal immigrants arrested at a north Arkansas poultry plant will be processed for deportation, but will not serve any jail time for using fake Social Security numbers and state identification cards, federal judges ruled Monday. Magistrate Judge Beth Deere and U.S. District Judge James Moody accepted guilty pleas from 17 of those arrested at the Pilgrim's Pride Corp. plant in Batesville last week. Federal prosecutors dismissed the misdemeanor charges against one man, but said they planned to ask U.S. Immigration and Customs Enforcement to begin deportation proceedings against him. The guilty pleas will give the 17 arrested criminal records, which will allow prosecutors to pursue harsher penalties if they illegally return to the United States. The charges carry up to up to 2 years in prison and $205,000 in fines, but federal sentencing ranges would have given them a maximum six-month sentence.

U.S. Attorney Jane Duke said her office had no interest in seeing those arrested serve jail time, as they were "otherwise law-abiding citizens." "They came here to better their lives and their family's lives by working," Duke said after the hearings. "There's really not a desire to see that kind of person incarcerated because the family they were trying to make a better life for would suffer." Three others face administrative charges of immigration violations after the raid Wednesday at the Pilgrim's Pride plant, part of a national sweep at company operations in Florida, Tennessee, Texas and West Virginia. Duke said federal agents had not arrested anyone else in the days after the Batesville raid, though whoever supplied those arrested with the Social Security numbers and identification cards remains at large. Those arrested all used their illegally obtained identifications to apply for jobs at Pilgrim's Pride, Assistant U.S. Attorney John Ray White said. None had previous criminal records. At an afternoon hearing, the men filed into the courtroom, most dressed in jeans and sneakers. Two wore rubber boots. The youngest was 18, while the oldest was 59. All wore headphones that allowed them to listen to the judge through a court interpreter.

Deere urged the men to be honest and tell federal public defender Jenniffer Horan if they had children living in the country who would be left behind. After the raid, state authorities said they took in no children. Those arrested during a July 27, 2005, raid on a Petit Jean Inc. poultry plant in Arkadelphia left behind about 30 children at schools and day cares. "We don't want to leave minor children in a precarious situation," Deere said. The judge also tried to put the men at ease by describing Guatemala and Mexico as "beautiful countries" and promising to learn Spanish. Most stood impassively by, staring straight ahead or at the courtroom's floor. One man audibly wept at one point during the hearing. "While they did break the law, they are not criminals," Horan told the judge. "They came to this country to seek a better life." Most men passed at an opportunity to speak, though Gavino Aguillan-Bautista, 59, did. Horan said the man had been living in the country for at least 13 years."I want to thank God for the life and health I had in this country," the Guatemalan told the court in Spanish. "I ask God to bless all of you in the United States." Deere offered her own thoughts after sentencing the men to the terms of the plea bargain. "I wish you all the best and God speed," she said. After the judge left the courtroom, the men placed their hands behind their back, waiting for the marshals to fasten their handcuffs.

Can you imagine a US citizen getting such emotional press coverage for stealing anything by using fake IDs? We should have jailed these people to put fear in other illegals and those who hire them. The real story about the raids is that Pilgrim's Pride is getting a complete pass for allowing several hundred people who can barely read in spanish to sneak into their food processing plants across the country. Apparently the standards for getting a job at Pilgrim's are so low, that one just has to show up with 1 or more fake IDs.

It is also interesting to note that we don't hear about the economic impact on Pilgrim's Pride from losing some of it's illegal workers. According to the Arkansas Friendship Coalition, illegals are needed by the state economy, yet Pilgrim's Pride is still surviving as a multi-million dollar corporation. Perhaps the media should start covering illegal hiring companies like Pilgrim's Pride the way they cover oil companies like Exxon!

Group Questions Dustin McDaniel's Ability to Decide Fate of Illegal Immigration Ballot Initiative Due to Campaign Contributions

Ballot Initiative Concerning Illegal Immigration Resubmitted
to Arkansas Attorney General

(Little Rock – April 17, 2008) The grassroots organization, Secure Arkansas, resubmitted an initiated act regarding illegal immigration to the Arkansas Attorney General for language review and approval on April 16, 2008. The act concerns federal, state and local public benefits currently provided to illegal aliens in Arkansas. Changes from the original version of the initiative, submitted on March 26, 2008, are in the areas of expanded definitions and additional legal references. The original intent of the initiative has not changed.

Massive Illegal Immigration raid

KeepArkansasLegal, an immigration reform group based in Arkansas, would like to express support for the raid on Pilgrim’s Pride Poultry Plant in Batesville,AR. We would also like to encourage the effort to prosecute the executive officers of this negligent company.

Illegals make up less than 5% of the US workforce and are less than 3% of the GDP. Studies that claim to show illegal aliens are a benefit to the economy mix illegal aliens with legal immigrants to hide the cost of illegal immigration. Illegal immigration has become a problem for the State of Arkansas as thousands of illegal aliens are smuggled into the state to be used as cheap labor by greedy corporations like Pilgrim’s Pride. The friends and family of those illegal workers end up on state benefits such as free education and food stamps. While Arkansas Citizens were busy filing their taxes, illegals were getting that tax money and a few greedy corporations were paying their illegal workers under the table. While the majority of companies in Arkansas are legitimate businesses that use the capitalist system, Pilgrim’s Pride decided to use the exploitation system that is used in corrupt regimes like China and Mexico.

We can expect the PR spin that will occur after this raid. Pilgrim’s Pride will get a pass for hiring hundreds of illegal aliens by claiming it was fooled by people who can’t even speak English, just like the excuse used by Petit Jean Poultry. A fake SSN can be checked on websites like checkmyssn.com. Many in the press will write guilt-trip stories about the families of illegals far more than they wrote about the family of Daniel Francis who was killed by an illegal alien in Arkansas. Groups like the AR Friendship Coalition will try to bring race into the issue and the Mexican Narco-Regime will complain about the raid since they believe US taxpayers are responsible for Mexican Citizens.

We believe that more raids should be done on crooked companies that hire illegals until they reform or go out of business. Companies that hire illegals should be forced to pay for all the expenses of processing and deporting the illegals they hired and the corporate executives should serve jail time for at least negligence. We also believe that state and local governments should do their part to force illegals out of the state. We urge the people of Arkansas to support the ballot initiative under review by the Attorney General which will require proof of citizenship to obtain state benefits. We also urge voters to support candidates who have the best record on opposing illegal immigration in upcoming May 20th election. We must follow the example of Oklahoma in reducing illegal immigration as much as possible!

Illegals shooting and important event

The Arkansas Friendship Coalition held a press conference at 2pm in the State Capitol in the Supreme Court Room. The whole room had about 15-20 people with about half dozen members of the AR Friendship Group in the front. I hurried in from work, then setup a camera, met with one of our group, and then held a sign along with some activists from Fayetteville . The conference was about an economic study done in Oklahoma. The study claimed that the effort to reduce immigration in Oklahoma had caused damage to the state economy. The ARFC then stated their opposition to any enforcement of immigration laws by local and state authorities. After the press conference, there was a Q/A session. The first questions came from the press. That's when the first concerned citizen stood up.

As it turns out, a member of KeepArkansasLegal has been investigating illegals doing construction at UAMS. The gentleman talked about how legal workers had been working on the construction at UAMS when contractors laid them off and replaced them with illegal alien workers for about half the wages. The ARFC refutted the statements about UAMS. One of the speakers claimed that illegals working at UAMS was "utter nonsense". Rita Sklar of the ACLU then made one of the most arrogant statements ever made in the Arkansas legislator; "If you want your press conference go and setup one yourself". The citizen demanded that they make an effort to investigate the matter.

After the UAMS exchange, a reporter asked about the ballot initative from securearkansas.com. The ARFC stated their opposition to the initiative but not in a strong way. When pressed they admitted that they would campaign and raise funds to oppose the ballot initiative. The Q/A session was ended and it seemed that whole thing would be over. That's when the press came to us! The activist from Fayetteville talked about the Daniel Francis shooting with details about how the illegal alien had been let go by the law multiple times and had even been deported. I talked about the shooting as well and then led into other examples of crime committed by illegals. I also mentioned the fact that this study appears to mix legal immigrants with illegal aliens and talked briefly about who really benefits from an illegal immigrant economic system. Afterwards, I had a more detailed interview with Kristin Fisher from Channel 7.
